1. GENERAL TERMS AND CONDITIONS

These General Terms and Conditions apply to all orders and sales transactions through the website www.ir-ma.be relating to the products offered on the website, as well as to all orders placed after receiving a price offer. By placing an order, you accept these Terms of Sale in full and without reservation.

2. SELLER

IR.MA conceptstore BV (hereinafter abbreviated IR.MA) has its registered office at Neerhof 3, 1650 Beersel and its place of business at Steenweg naar Eigenbrakel 7, 1652 Beersel. 3. APPLICATION

IR.MA may unilaterally amend the Conditions of Sale at any time. Any amendments to the Conditions of Sale will only apply to orders placed on or after the date of amendment. Only IR.MA's Conditions of Sale apply to the agreement and not those of the customer.

4. PRICE OFFERS

Price offers received via [email protected] are valid for one month. The customer must pay the total amount of the price offer within this period if he/she wishes to proceed with the order. After delivery of the goods, the same right of withdrawal as stated in these General Terms and Conditions of Sale applies.

5. PRICES

All our prices include the applicable VAT rate and exclude shipping costs. Prices and availability of items are subject to change without notice.

6. PAYMENT OPTIONS

For payment, you can choose from the following options: payments via Bancontact and Credit Card. For none of these payment options, costs are charged to the buyer by IR.MA

Payment of the price must be made at the time of the order, and therefore prior to delivery, using the aforementioned payment methods.

IR.MA has made every effort to optimise the security and confidentiality of the online payment, but is in no way liable for any theft, loss of data or any other damage suffered by the purchaser or a third party as a result of the online payment.

Until the time of full payment by the buyer, the goods delivered to the buyer remain the property of IR.MA.

7. DELIVERY

Shipping takes place within five working days of receipt of payment for Belgium and up to longer for international shipments. No delay in delivery can give rise to cancellation of the purchase or payment of damages in favour of the buyer, except in cases of deliberate delay.

Incorrectly provided delivery addresses are the buyer's responsibility and may lead to additional costs. Unless otherwise indicated, our prices do not include transport and delivery of the goods to the buyer, these costs are stated separately.

We have the right to make partial deliveries. In the event of non-delivery of the goods, any sums paid by the buyer will be refunded without interest or other compensation. The goods are only offered by IR.MA on the webshop while stocks last.

If, after the conclusion of the order, it appears that the goods purchased by the buyer are no longer in stock, IR.MA undertakes to notify the buyer within a period of fifteen (15) calendar days and to issue a credit note to the buyer cancelling the order. The purchaser undertakes to transfer its account number to IR.MA without delay after the aforementioned notification, so that IR.MA can refund to the purchaser any funds paid by the purchaser within a period of fifteen (15) calendar days following notification by the purchaser. IR.MA cannot be held liable in any way if the buyer should fail to transfer the account number as mentioned above to IR.MA. The buyer irrevocably waives any right and any claim for damages that would result from the termination of the sales contract due to stock depletion.

Any costs, taxes, customs and import duties as well as formalities associated with deliveries outside Belgium are entirely the responsibility of the buyer. IR.MA is in no way liable for the consequences of non-compliance with certain payment, tax and/or declaration obligations associated with deliveries outside Belgium.

8. PRODUCT DESCRIPTION

IR.MA tries to be as accurate as possible, but we do not guarantee that product descriptions or other content are accurate, completely reliable or error-free. We reserve the right to correct errors inaccuracies or omissions and to change or update information at any time without notice.

9. LOSS AND DAMAGE DUE TO SHIPMENT

IR.MA cannot be held responsible for damage, theft or loss of goods during shipment. We do everything we can to pack the goods as well and as safely as possible.

The buyer is obliged to check the condition of the delivered goods when they are handed over by the transport company. If the packaging of the delivered goods is opened and/or damaged, the buyer must report this to the transport company and state this on the dispatch note at the time of receipt.

Each package can be tracked online using a unique barcode. In case of problems with the receipt of the sent package, the customer can contact the carrier stating this barcode.

10. FORCE MAJEURE

IR.MA is not liable for delays due to events beyond our normal control. This includes production stoppages, transport delays, strikes, work stoppages, delays of transport, production interruption, omission, war, natural disasters, embargo, political conflicts, sabotage, accidents, that can affect both ourselves and our suppliers, even if they are foreseeable.

11. RIGHT OF OWNERSHIP

This website and the subdomains are the property of IR.MA conceptstore. No data or photos can be copied without permission of IR.MA.

12. DISPUTE SETTLEMENT

The EU has set up this site to help dissatisfied consumers. Through this site, you can complain about products or services you bought over the internet, and look for a neutral third party to resolve the dispute. In some countries, you can also file a complaint against a consumer as a trader. If that is the case in your country, you can also do so via this site (see link below). Just click on the link above. 13. GUARANTEE

As required by legal provisions, our products are also covered by a legal guarantee. If a product does not comply with the agreement, the buyer must inform the seller of this within 5 days following delivery. Any compensation for this can never be greater than the invoiced/paid amount to the buyer.

Ordinary or normal wear and tear, unintentional or deliberate changes made by the buyer to the product, failure to present an invoice or valid proof of payment and various omissions are explicit but not exhaustive exceptions to the aforementioned guarantee scheme.

The buyer is obliged to notify IR.MA when the goods are defective via [email protected] and to provide the necessary description and photos of the defects, within 5 calendar days following delivery to the buyer. IR.MA undertakes to remedy the defects within a reasonable time in accordance with its obligations under applicable Belgian law.
